Checking books, accounts etc

Hi all,
today David Bonham and myself went to B&A to hand out a notification that we wish to see into the books, accounts, contracts, etc. of "La Finca". The date will be coming thursday 04th of october at 09h30 in the office of B&A. Present at this meeting will be David, Adriana, Ron and myself. I guess it would be a good idea if there would be a qualified spanish owner present as well! So please let us know if you wish to join us. If I forgot about someone who already mentioned to come with us I do apologize!! I will doublecheck

If it is any help, I am an accountant/auditor by profession and although I am over in the UK at the moment I am more than happy to assist; for example if you wanted to email me over any documents/balance sheets etc I could look through them to help identify any further questins etc

This step by step convert to be a "court" case and we became "lawyers and judges". Esto poco a poco se transforma en un juicio donde nosotros somos los"abogados y el juez".

But we need to do something and to prove the truth. Pero tenemos que hacer algo en mostrar y sacar la verdad a luz.

Regarding the email what was sent from the CDAD on behalf of Sandra is just good, becuase it is another written proof against herself,(completely contradictory to what she wrote in the burofax, signed by her in the name of committee who never agreed to such thing) as I will call tomorrow 7 islas SL to ask for the last 3 months weekly report, which definetly will proove that she is a liar!
I only hope she is reading this forum so at least she could see the evil she is doing to herself. We are a good community with good people and well educated, respectable, but we can not stand the unjustice neighter done by her nor by other future president.

Respeto al correo de CDAD en el nombre de Sandra es bueno porque tenemos mas pruebas escritas contra ella (es contradictorio con que esta puesto en burofax firmado por ella en el nombre de comite, que nunca firmo una cosa como este), porque yo mañana llamare 7Islas SL para pedir los reportes semanales de los ultimos 3 meses, que por seguro va a demonstrar que ella, Sandra, es una mentirosa! Espero que esta leendo este forum y se da cuenta de lo malo que lo esta haciendo a su misma. Somos una comunidad buena, con gente buenos y educados, respetables, pero la injusticia no es admitible, nia ella ni a otro futuro presidente!

I am so so so sorry for all this, and definetly Sandra needs help, medical help or a profesional help... this is not normal what is happening! Some people suffer of claptomania, other of arahnaphobia, claustrophobia, paranoism, etc...but I have never heard how is called the sickenss that causes this personality damage and make people lie, invent, imagine and believe certain things which never happened or said. So sad! What a pitty!

Tengo mucho lastima por todo esto, seguramente Sandra necesita ayuda, medica o profesional...no es normal que esta pasando! Algunos estan sufriendo de claptomania, otros de arañafobia, claustrofobia, paranoia, etc...pero nunca he oido como se llama la enfermedad que causa daños en la personalidad que hacen la persona miente, invente,imagine o cree cosas que nunca le ha pasado o nunca se ha dicho. He estado siguiendo el forum y estoy muy sorprendido por las acusaciones por la irregularidades ye ilegalidades que están ocurriendo en la finca. Como propietario estoy muy preocupado por la mala administracion de nuestro dinero. Por lo que he leído todas estas acusaciones son totalmente denunciables ante un juez.

Un abogado siempre necesitará un informe pericial que demuestre falsificación de documentos: facturas, firmas, et, Malversación de Fondos etc.

Yo no soy abogado pero si un Ingeniero de Telecomunicaciones de profesión que además ejerzo como Perito Judicial para la companía Grupo Pericial http://www.periciales.es (Peritos Judiciales y Forenses). La empresa esta formada por una serie de profesionales expertos en cada rama.

Mi especialidad como Perito Judicial es la seguridad informática y seguridad en redes de datos e internet. Deciros que un simple email constituye una prueba para el informe pericial.

También deciros que un EGM puede ser convocado por el 25% de la comunidad acogiendonos al artículo 15 de la LPH sin tener que esperar por el presidente para que convoque el mismo.

Si teneis alguna pregunta con relación a la LPH no dudeis en preguntarme.

I've been following the forum and I am very surprised by the accusations regarding irregularities and illegalities that are happening in La Finca. As the owner I am very concerned about the mismanagement of our money. From what I've read with all these accusations we have got a court case.

A lawyer will always need a legal expert to prove the falsification of documents including invoices, signatures, etc. Embezzlement, etc.

I am not a lawyer but a Telecommunications Engineer that also work as a Legal expert for the company Grupo Pericial http://www.periciales.es (Legal and Forensic Experts). The company is formed by a number of qualified professionals.

My specialty as Legal expert is computer security and networks and Internet security. A simple email is a valid probe for the final legal report.

In accordance with Article 15, an EGM may be called by the 25% of owners without having to wait for the president to convene it.

My sole interest in this matter is to discover whether or not our monies are being used appropriately. From previous information provided by Jose to all owners all appears to be in order and this appears to be confirmed by Sandra's email of yesterday. If I were there on Thursday the main things I'd be looking at would be the bank statements and how these compare to the bank balance in the accounts and also taking a sample of payments and verifying these against invoices/receipts.

yo creo en la justicia y verdad! Siempre la VERDAD te hace libre! Creemos que todo la verdad debe presentarse publicamente en una junta extraordinaria en echos y por lo tanto se esta preparando la firmas para la junta extraordinaria. Debe venir todo aquellos a quien le importa, en su propio interes, que estaba pasando en el pasado, que esta pasando en el presente y que no debe volver a pasar en el futuro, indiferentemente de quien sera el presidente o junta directiva o administracion. We beileve that the truth has to be presented in public in an extraordinary meeting by facts, and for this is in process the collection of signitures for the extraordinary meeting. All those who care, for themselves and own interest, must come and be interested in what was happening in the past, what is happening in the present and what must not happen in the future, regardless of who will be the president or committee, or administration. It is in our common own interest to have the extraordinary meeting right away where we decide what we want in facts. It is our property, our administration and our community! Please can we have an update on the outcome of the review of the books and accounts ?

We were waiting for the administrator professional inform, which had a due date on Monday,8th of November and nothing happened....this leaves space for allot of question marks. So we advised the administration to have it done in a nice amiable way otherwise we see ourselves forced to ask an external audit >/which will show up evrything, all irregularities. It was a letter sent to all of us from the administration in the name of the president saying how "much" savings they have made and how good they are, but they just to forget to mention that if we have to pay all outstanding invoices will empty the bank account and also they have forgot that if we have to pay penalties to the Gardener (as well as we had to pay for the other exemployees for not legal dismiss more than 18000 euros in 2009 and more than 4000 euros in 2010) will increase our debts to thousands of euros which we do not have! It was told in the letter that we have another gardener for only 1350 bruto per month with a contract, but it comes out that there is no such a signed contract and on top the "new gardener" the second day left because he never agreed to such amount, and etc...than on the letter it was said by the president that she dismissed the gardener for bad maintanace of the pool, which we searched and results to be a lie, because we have the weekly reports from 7 Islands SL as being checked and mantained in a very good level! ...and seriously, from 29th of october since Eugen was kicked out till 1st of November are quiet many days to not clean the pool and than pay someone to say what "it has to be said" to justify illegal and no moral base actions! Than , the letter says that the gardener was dismissed for asking more money, which is not true because in august 2010 it was signed a new contract for 1 year with the same condition like in 2009, so no increase of the monthly fee, and on top in the books I have found 2 invoices put in the petty cash like being paid for 100 euros each, which have never been paid! Also we have found check signeb in the gardener´s name as advance payment but signed by the president as receiver! ....other question marks... About "savings" why and who agreed to pay 1500 euros for stainless steal boxes when we cannot afford it??? and more and more unexplained and aproved expenses!
We had to agree for the kids´ playground in a full extraordinary meeting to spend 1000 euros for tables, chairs and ping-pong table, and had to vote everybody, but to spend for those boxes, or 1600 in "correos" burofax etc, or high telefone bills and etc no one was consulted!!! We have found 44 irregularities which leads to a very poor managment of the complex! I sugest to creat a strong committee with a president who is willing to cooporate for our interest, not in personal judgements without consulting anyother of us who pays for that! if I let someone manage my money I want to be updated where and for what it was spent or invested. isn´t it the same with all of us? I guess that letter is just a missleading and had to be proved in facts and documents all what was written and affirmed!
About the vicepresident, "being absent" is another wrong information, as he was ordered in writing by the president herself, to stay away because the law says that he can say, add, or act only if the president is not present which he was told was not the case...please draw your own conclusions.....................
